Sentencing Guidelines

The following Class I Felonies carry 4 to 15 years

 

•   Criminal Sexual Assault
•   Aggravated Robbery
•   Residential Burglary
•   Residential Arson
•   Vehicular Invasion
•   Vehicular Hijacking
•   Burglary committed in a school or place of worship
•   Aggravated discharge of a Firearm

 

Firearms Add-Ons

 

• 15 years is added if the crime was committed while, “armed with a firearm”.
• 20 years is added if the defendant personally during the commission of a crime “discharged a firearm”.
• 25 years or any term up to natural life is added if during the commission of the crime the defendant “personally discharged a firearm that proximately caused great bodily harm, permanent disability, permanent disfigurement, or death to another person.
• Machine guns and Silencers

     Class X Felony, not less than 12 years and not more than 50 years
